We have all heard of racist covenants placed on various properties in the province, whereby a property is not allowed to be sold to a person of a certain ethnicity. These are illegal and unenforceable and are generally removed from title without issue once the Land Title Office is notified.
But this is something new – a racist covenant allowing neighbouring lot owners to seize property if it has fallen into possession of any Asiatic, Negro or Indian. In over 35 years of real estate law I have never seen this!
Clearly this is unenforceable and will be struck if the homeowners take action, but this is yet another reason why every realtor needs to have the charges on title reviewed!
Do it yourself, have your lawyer do it or use Terra Firma, but have all non-financial charges on title reviewed.
